1. PROVISIONS

1.1 Terms and conditions herein Operated by the Users website at www.edunative.online, it offers online English lessons for children and adults. Children and adults participating in the classes can learn English individually or in groups over the Internet, with the help of an English teacher who is a designated teacher of www.edunative.online

2. REGISTRATION, CONTRACT

An Agreement is contracted between Edunative and the User when the User creates a registration through the Website by following the steps below:

2.1. Although the service provided by Edunative is included for children, individuals under the age of 16 who are not adults will not create an account on the Website. Minors will only use the Website and Services with the consent of their legal guardians or representatives (eg, parent, foster parent, step-parent, etc.).

2.2. During registration, the User's e-mail address, name, surname, phone number and whatsapp are required. The user will determine the date of the Trial Lesson after entering the necessary information.

2.3. The Service Provider shall not be liable for any damages that may arise due to the User providing false and/or incorrect information.

2.4. The Service Provider shall not be liable for any damages caused by the User's e-mail address and/or password being made available to unauthorized persons. In case the user forgets or loses his/her e-mail address and/or password or if they are disclosed to unauthorized persons, he/she can request support from the Service Provider by using the chat service on the Website.

2.5. The Agreement concluded between the parties will be accepted as a written agreement drawn up in English. The Service Provider sends the above information to the User in writing at the request of the User. Relevant information is considered written when sent to the User's e-mail address.

2.6. The User uses the Website by assuming all relevant risks and responsibilities.

3. SERVICES (Lessons)

3.1. Trial Lesson

Before a Payment Structure is purchased, Edunative.online will arrange a Trial Lesson for the User at the User's request. Trial Lessons aim to measure the student's English level. While completing a Trial Lesson is not a prerequisite for starting the Lessons, the Student can only start at the entry level if the Student's English language knowledge has not been assessed beforehand. A Trial Class is mandatory for the student to start at a more advanced level.

Edunative determines the teacher who will take the Trial Lesson. The user's decision is not required.

The User can    postpone or cancel the Trial Lesson at least 3 (three in writing) hours before the Trial Class starts. Failure of the user to take action during this period shall mean that he/she accepts the time of the Trial Lesson. If the User does not attend the lesson within 10 (ten in writing) minutes as of the scheduled start of the Trial Lesson, the Teacher may stop waiting for the User and the Trial Lesson will be deemed to have been completed. In this case, Edunative may refuse to issue another Trial Lesson for the User. After the Trial Lesson is complete, Edunative may recommend a Teacher and Lesson schedule for the Student based on the Student's level. Edunative's assessment of the Student's English proficiency may not be the same as the User's previous assessment from third parties.

3.2. Teacher and Lesson plans

Edunative has the right to choose a suitable plan for the Student and their Teacher, depending on their English proficiency level. If the User does not pay for the Subscription until 24 (twenty-four in writing) hours before the start of the Lesson, the reservation will be cancelled. The User can then request Edunative to replace the Tutor and will explain the reasons for their request. Edunative may change the Tutor at its sole discretion; however, Edunative will inform the User at least 1 (one in writing) hour before the start of the relevant Lesson and without causing undue delays.

3.3. Lesson procedure

The course start time will be the start time specified in the User's Curriculum.

The duration of the lesson is either 30, 45, 60 or 90 minutes as of the start time. If the User or Teacher experiences technical difficulties during the Lesson (eg internet outage), they can reconnect to the Lesson within the scheduled timeframe.

The Service Provider records the videos/photos of the course if the User agrees it.

At the end of each Lesson, the Teacher may assign the Student the recommended homework assignments until the next Lesson.

If the user does not complain to the Service Provider about the quality of the lesson 24 hours after the lesson, that is, within twenty-four hours from the start of the lesson, the lesson is considered to have been conducted properly. The service provider reserves the right to evaluate the User's complaint individually and to refund the course fee to the User's balance if there are valid reasons.

3.4. Course cancellation and postponement

User Cancellation or postponement of the Lesson is possible up to 12 (twelve in writing) hours before the lesson starts. If the User misses this deadline, it will mean that the User has accepted the suggested Lesson time and the User's Payment will not be refunded if the Student does not attend this Lesson.

The user can cancel or postpone a maximum of three lessons per month. The canceled course must be compensated within 1 week by agreement with the teacher.

The teacher will have the right to postpone and cancel the Lesson, provided that Edunative is informed in advance. In this case, a substitute Teacher will be assigned to the Course, provided that the User has given permission in their account.

In case of no substitute Teacher for the Course, the Service Provider will inform the User about the cancellation and the Course will not be deducted from the respective User's Balance.

3.5. Absence from lessons

If the Student does not come to the Class at the scheduled start time, the Teacher will wait for the Student for 15 (fifteen in writing) minutes. If the Student does not start the Class within this time, or the User does not notify the Service Provider in advance that the Student cannot attend the Class, the Lesson will be deemed completed and the Lesson will be deducted from the User's Balance.

If the student is late for the lesson, the lesson process will not exceed the time defined for him.

Lessons not held due to the fault of the Teacher will be canceled free of charge (without deducting from the User's Balance) or will be postponed to a suitable space for the User in the Teacher's schedule.

3.6. Freezing of lessons

The User shall have the right to temporarily suspend scheduled Lessons by sending a message to the Service Provider via the Chat Service. Other Users will be able to use the relevant hours, as the lessons that the User has planned for the freezing period will be deleted from the Teacher's program.

When the User decides to continue the Lessons, the User and the Service Provider will determine the Lesson schedule together.

3.7. Communication about courses

User, Teacher and Service Provider can share course related topics via Whatsapp, Telegram etc. will meet with you. Edunative Lesson determination, Lesson cancellation, replacement Teacher appointment and other events using the contact information provided by the User by e-mail or Whatsapp, Telegram etc. will notify.

Due to the nature of these communication methods, Edunative does not guarantee the delivery of such messages.

4. PAYMENT STRUCTURES AND TERMS

4.1. Payment

The User must select and pay a Payment Structure on the Website to access the Services offered on www.Edunative.online.

4.2. Package

When the User purchases a Package, the number of Lessons included in the Package will be added to the User's Balance. If there are unused lessons in the User's Balance and the User does not use at least one lesson during this period, the services covered by the relevant Package are deemed to be fully provided and Edunative has no obligation to return the Payment to the User.

4.3. Promotion and discounts

Edunative has the right to offer discounts and promotions to Users on dates and for a period to be determined at its own discretion. Service provider; Discount and Promotion offers and conditions will be stated on the Website in order to inform the User. Service provider; may initiate, terminate and/or change the terms of Discounts and Promotions as it sees fit. These changes will be announced on the Website without delay in order to inform the Users.

4.4. Giving a lesson as a present

Edunative can also provide Gift Lessons in various activities and competitions.

5. OBLIGATIONS OF THE USER

5.1. Users are obliged to provide their own information and their children's information correctly when they sign up. The User shall be responsible for all damages and expenses incurred by the Service Provider, User or third parties due to incorrect information provided by the User.

5.2. The user is obliged to comply with the applicable legislation regarding personal data and documents uploaded during and after registration.

5.3. The User and Student may not engage in behavior that overloads the Website or Application, renders them inaccessible or prevents them from working, and may not upload viruses or malicious code.

5.4. The User and the Student will be responsible for any damages (including any compensation) incurred by the Service Provider or third parties when the User or Student does not fulfill their obligations set forth in the GTC (general terms and conditions). Edunative has the right to remove User content that violates the GTC immediately and without informing the User, or to prevent the User and Student who share such content directly or indirectly from using the Service.

5.5. Service provider; assumes no liability for damages caused by erroneous, inaccurate, ambiguous or illegal content provided by the User or Student, including compensation.

5.6. The User and the Student are obliged to comply with the provisions of the GTC and other regulations of the Service Provider. The responsibility for all damages caused by the breach of these provisions, including compensation, shall be the User's responsibility. Edunative has the right to prevent the User from using the Service, who violates his obligations set forth in this provision, without informing the User.

5.7. User; accepts that he/she will not be able to recover the service fee he/she has paid when he/she is removed from the Services due to unlawful behavior or contrary to these GTC or other documents published by the Service Provider.

6. MODIFICATION AND TERMINATION OF THE AGREEMENT

6.1. The Service Provider shall have the right to unilaterally change the GTC and any of its integral parts at any time. The Service Provider shall publish the amended version of the GTC on the Website and notify the User via a system message or by sending an e-mail to the e-mail address specified in the User's accounts. Services initiated before and after the amended GTC posting will be subject to the amended GTC.

6.2. The User shall have the right to cancel his registration at any time by sending an e-mail to the e-mail address support@edunative.online or via the Chat Service. Cancellation of registration will also mean that the Agreement with the Service Provider is terminated. Once the registration is cancelled, the User's profile will be removed and the User will no longer be able to access the Lessons.

6.3. The Service Provider shall have the right to terminate the Agreement immediately if the User violates any of its obligations under these GTC and other regulations of the Service Provider under any jurisdiction or applicable law.

6.4. Service Provider; If the User is under the age of 16 and is not an adult, the Service Provider determines or learns that he/she has registered and/or used the Application without the consent of his/her legal guardian/parent, if he/she does not have legal capacity or is partially, or if such a possibility occurs, the Service Provider shall inform the legal representative or the legal guardian has the right to send a warning to the User in order to verify in a reliable manner and within a reasonable time, not exceeding 5 (five in writing) days. User; The Service Provider has the right to terminate the Agreement immediately and delete the User Account immediately if it does not reasonably verify the consent of its legal representative or legal guardian.

6.5. The Service Provider reserves the right to terminate the Agreement concluded with the acceptance of these GTCs without giving any reason and by giving 10 (ten in writing) days' notice via e-mail.

6.6. Edunative will notify the User of the termination of the Agreement by sending a message to the e-mail address or telephone number provided by the User during registration.

7. INTELLECTUAL PROPERTY

7.1. When the User agrees to these GTCs, including but not limited to data, information, images, text, music, audio and other content, drawing, user interface, audio and video clips, editorial content, scripts and software used for the implementation of the Services It acknowledges that the Services contain information and materials whose rights belong to Edunative and that such information and materials are protected by applicable intellectual property and other legislation, including but not limited to copyright protection. The User agrees not to use such proprietary information or content for the non-commercial and personal purposes of the Services specified in these GTC. Reproduction of any part of the Services other than in forms and methods expressly permitted in these GTC is prohibited. User; It agrees that it is strictly forbidden to modify, rent, sell or distribute the Services or any portion thereof, and shall have no right to use the Services in any manner not expressly provided.

7.2. The Edunative name, the Edunative logo and other trademarks, images and logos associated with the Service are or are trademarks of the Service Provider. The User shall not have any rights or usage rights regarding the above mentioned trademarks and intellectual property.

7.3. Visual components, text and technical solutions and layout and design of the interface of the Website, software used and other solutions, ideas and content shared by the Service Provider on the Website are the copyrighted intellectual property of the Service Provider. Copying them in whole and/or part violates copyrights.

8. NO WARRANTY, LIMITATION OF LIABILITY

8.1. Users may use the Services only at their own risk: The Service Provider acknowledges that the Service Provider shall not be liable for material damage and personal violations related to use, except as a result of intent, gross negligence, criminal misconduct, and breach of contract that leads to death or harms physical integrity or health.

8.2. The Service Provider assumes no responsibility for the behavior of the User or Student. The User and the Student are responsible for their own behavior, including the data and other documents recorded on the Website.

8.3. Edunative shall have the right, but not the obligation, to follow the content provided by the User while using the Services. The Service Provider shall have the right, but not the obligation, to search for signs of illegal activity in the video and photographic recordings of the Lessons. The User agrees that the Service Provider assumes no liability or responsibility for the data edited and uploaded by the User.

8.4. The User shall be liable to the Service Provider for any damages incurred by the Service Provider due to the incompatible and/or illegal use of the Services by the User or the Student.

8.5. The User is not entitled to use the Services for advertising or other promotional or political purposes without the prior written consent of the Service Provider.

8.6. Edunative makes no other representations or warranties of any kind regarding the Services. In particular, it does not guarantee:

● User's uninterrupted and error-free use of the Services. The User acknowledges that the Service Provider may disable the Services from time to time for an indefinite period, or freeze or terminate the Services for technical and operational reasons that may vary from time to time. The Service Provider will notify the User of such situations, if possible;

● Services will be resistant to loss, failure, attack, virus, interference, obstruction, cyber hacking and other factors affecting security. These events are considered Force Majeure and the Service Provider will not be held responsible in any way for these events.

8.7. User; You agree to use the Service, the Website only for the purposes permitted in the General Terms and in accordance with applicable laws, regulations or generally accepted practices or guidelines in the applicable jurisdictions. In addition, the User;

While using the Service and the Website, the User agrees that the actions of the User do not violate the laws of the country or region where the User inhabits or resides, or the rules and regulations of the country or region in which the Service, the Website operates. This acceptance includes compliance with applicable export and import and other restrictions.

9. OTHER PROVISIONS

9.1. Edunative may send its legal statements regarding the GTC and binding the User by sending a system message to the e-mail address provided by the User during registration. The system message will be deemed to have been delivered as soon as it is sent to the e-mail address registered by the User.

9.2. Edunative; It has the right to present advertisements and other marketing content on the Internet Site.

9.3. Edunative; reserves the right to make changes or corrections on the Website whenever it sees fit and without prior notice. The Service Provider also reserves the right to offer the Website on another domain.

9.4. The GTC will enter into force as of its publication on the Website and will remain in effect until canceled or amended.
